Milk Choice



Overview


White milk being poured and creating a splashThe Consumer Milk Choice Act, signed into law on September 26, 2024, legalized the sale and distribution of raw milk in Delaware under the oversight of the Delaware Department of Agriculture. The Delaware Department of Agriculture is committed to supporting milk choice in Delaware through the Act’s implementation and expects to begin permitting facilities in the first half of 2025. Updates and information on the purchase and distribution of raw milk in Delaware can be found below.

PROPOSED REGULATIONS AS PUBLISHED 3.1.25 3 Del.C. §3181 Delaware Raw Milk Regulations

  • A public hearing will be held on March 25, 2025 at 9:30 a.m. in Conference Room A at the Delaware Department of Agriculture, 2320 S. DuPont Hwy, Dover, Delaware. Interested parties may offer written comments on the proposed regulations or submit written suggestions, data, briefs or other materials to the Delaware Department of aGriculture at the above address as to whether this proposed regulation should be adopted, rejected or modified. Pursuant to 29 Del.C. §10118(a), public comments must be received on or before April 11, 2025. Written materials submitted will be available for inspection at the above address.
